Understanding the New Impairment Notices and Disability Requirements

The NDIS is introducing several new processes to improve how support is delivered and accessed. These changes, including impairment notices and revised disability requirements, are aimed at providing more tailored support and clearer guidelines. Here’s everything you need to know.

Impairment Notices: A New Way of Documenting Support Needs

Starting from 1 January 2025, all new participants entering the NDIS will receive an "impairment notice." This important document will confirm whether a person has a permanent disability or significant impairment. It will also outline which impairments meet the NDIS's disability or early intervention criteria.

For current participants, impairment notices will be issued when transitioning to a new plan. This change recognises that people with the same diagnosis can have varying support needs. The introduction of impairment notices allows the NDIS to better tailor support to meet individual needs, ensuring participants receive the most appropriate assistance for their unique circumstances.

Clarified Disability Requirements for Accessing the NDIS

The NDIS access criteria are also being updated to provide clearer guidance. While the exact implementation date for these changes is yet to be confirmed, they are designed to give both new applicants and current participants a better understanding of how they meet the NDIS's disability or early intervention requirements.

This clarity will help ensure that participants know why they qualify for NDIS support and what specific criteria they meet. Additionally, it will draw clearer lines between when the NDIS should provide support and when mainstream services are responsible. This change is especially important for those applying to join the NDIS or those undergoing reassessment for continued access.

Requests for Information and Plan Revocations

Another important update is the enhanced authority of the National Disability Insurance Agency (NDIA) to request information from participants. If the NDIA is considering revoking a participant’s access to the NDIS, it may require additional details or request that participants undergo an assessment.

It’s crucial that participants comply with these requests promptly, as failure to do so within a reasonable timeframe could result in the NDIA revoking their access. If a participant’s status is revoked and they request a review of that decision, they will not be able to submit a new access request until the review is complete.
